Gjykata Kushtetuese/ “Venecia” rrëzon Ramën, Meta ka të drejtë

Në debatin e fortë për radhën, afatet dhe mënyrën se si bëhet dekretimi dhe betimi i Gjykatës kushtetuese ka dhënë më në fund mendimin e tij edhe Komisioni i Venecias.

Ajo ishte thirrur të ndante konfliktin e fillim nëntorit të shkuar, kur shumica qeverisësë u mundua ti rrëmbejë kreut të shtetit, emërimin e një anëtari të Gjykatës kushtetuese.

Palët u ngërthyen në një konfikt ligjor, nëse aty duhet të shkonte Marsida Xhaferllari (sipas Metës) apo gjykatsja e betuar në Lanë, Arta Vorpsi (sipas socialistëve).

Për të realizuar qëllimin e saj, PS vuri në veprim Kryetarin e Këshillit të Emërimeve në Drejtësi (KED), Ardian Dvoranin, Parlamentin dhe ministrinë e drejtësisë.

Qëllimi i gjithë këtij zinxhiri qe që të dëshmonte se presidenti e kishte humbur të drejtën e përcaktimit të një kandidati (afatin 30 ditor) dhe kështu në kushtetuese katapultohej direct, Arta Vorpsi.

Me këtë lëvizje arriheshin dy objektiva. Edhe Vorpsi quhej e zgjedhur, nëse emri i saj dilte në fletoren zyrtare edhe parlamentit i jepej mundësia të çonte në gjykatën kushtetuese dy gra të tjera, Fiona Papajorgjin dhe Elsa Toskën.

Opinioni paraprak për emërimet në Gjykatën Kushtetuese ka rrëzuar pretendmet e qeverisë se presidenti ka shkelur ligjin.

Komisioni i Venecias konstaton se mënyra e veprimit të KED të përfaqësuar nga kreu i saj Dvorani është e dyshimtë.

Ai i ka dhënë një goditje edhe shumicës parlamentare duke arritur në përfundimin se ligji për ndryshimin e betimit tek Presidenti është antikushtetues. Sipas Komisionit të Venecias, Presidenti Ilir Meta ka vepruar sipas gërmës dhe logjikës kushtetuese.

Nga ana tjetër, Venecia konstaton se nuk ka bazë për shkarkimin e Presidentit, pasi veprimet e tij kanë qenë në përputhje me interpretimin e arsyeshëm të Kushtetutës.
