Skandali Milot-Balldren/ KLSH: Tre shkeljet e Arben Ahmetajt me “rrugën e florinjtë”

Kontrolli i Lartë i Shtetit, përmes një auditi të thelluar, ka konstatuar shkelje të rënda nga ana e Ministrisë së Financave që drejtohej nga Arben Ahmetaj, lidhur me miratimin e projektit të koncesionit të rrugës Milot-Balldren, kosto e së cilës kap shifrën e çmendur prej 256 milionë eurosh, ose 15 milionë euro për kilometër.

Sipas raportit, të cilin Gazeta SHQIP e disponon, KLSH ngarkon me përgjegjësi direkte ministrin e asaj kohe, Arben Ahmetajn dhe 6 zyrtarë të tjerë, për miratimin e kësaj kontrate abuzive. Në raportin e KLSH konstatohen një sërë shkeljesh që janë anashkaluar nga MFE, e cila miratoi projektin ku 1 km rrugë në fushë u kushton shqiptarëve 15 milionë euro. Sipas raportit të KLSH, në kontratën që u rinegociua pa garë konstatohet se koncesionari nuk ka para për tiu përgjigjur projektit, ka fryrje e kostove, si dhe gabime në parashimet e flukseve të parasë. Pavarësisht problemeve, kontrata u firmos nga Arben Ahmetaj, të cilin KLSH e bën përgjegjës.

Kostoja e ndërtimit

Fillimisht, në relacionin e buxhetit për 2018 qeveria kishte përcaktuar një fond total prej 113 milionë euro. 7 muaj më vonë kostoja e rrugës u shtua me 48 milionë euro duke shkuar në 161.5 milionë euro, vlerë kjo e paraqitur nga kompania ANK sh.p.k e cila hyri në garë me propozim të pakërkuar.

Kompania negocioi dhe normën e fitimit e interesat për 13 vitet e shlyerjes duke e çuan koston e rrugës në 213,7 mln euro, e cila në total bashkë me TVSH arrin gati 260 milionë euro.

Sipas kontratës, ANK do ta ndërtojë aksin 17.2 kilometër nga Miloti në Balldren me paratë e veta(të cilat nuk i ka) dhe më pas do të shlyhet nga buxheti i shtetit me këste për 13 vjet

Sipas analizës financiare, kostoja e ndërtimit dhe mirëmbajtjes është 161 500 000 euro dhe pagesat nga buxheti i shtetit kapin shumën 217 318 500 euro, që rezulton një kosto financimi e raportuar në interesa në shumën 56 918 500 euro.

Mungesa e fondeve

Raporti konstaton se kompania nuk ka kapacitete financiare për të ndërtuar një projekt të tillë. Ndërsa ANK premton të financojë 62 milionë euro nga kapitali i vet dhe huatë nga, të dhënat zyrtare nga bilanci 2017 tregojnë se totali i aktiveve të saj është vetëm 16 milionë euro (2 miliardë lekë), ndërsa totali i kapitalit është 3.2 milionë euro. Kostoja e ndërtimit është 141 milionë euro dhe kjo tregon se kompania ka marrë përsipër një punë për të cilën nuk ka fonde. I njëjti shqetësim konstatohet edhe për periudhën që parashikon mirëmbajtjen e rrugës, për të cilën kompania nuk ka fonde të mjaftueshme.

Studimi i fizibilitetit, shkeljet e ministrisë

Nga auditimi konstatohen shkelje të MFE në lidhje me miratimin e dhënë si në aspektin e implikimeve financiare mbi studimin e fizibilitetit ashtu edhe në drejtim të risqeve të marra nga sektori publik.

Struktura e financimit

Supozimet e studimit përfshijnë financimin me 115 milion euro hua bankare dhe 50 milion euro investim nga kapitali i kompanisë, nga të cilat 30 milion Euro për realizimin e investimit dhe pjesa tjetër prej 20 milion euro për mirëmbajtjen. Në total kostoja e investimit dhe mirëmbajtjes sipas vlerësimeve është në shumën 161.5 milion euro ndërkohë që modeli i financimit përfshin burime në shumën 165 milion euro. Diferenca prej 3.5 milion euro financim shtesë përtej nevojave për investim dhe mirëmbajtje sipas modelit të propozuar rëndon me kosto shtesë financimin përtej nevojave reale, duke përfshirë kostot e interesit.

Gabimet në parashimet e flukseve të parasë

Për tre vitet në të cilat është parashikuar që të realizohet investimi, vendosen në dispozicion fonde të panevojshme (krahasuar me nevojën për para për kryerjen e investimit) që në vitin e parë e cila vazhdon deri në vitin e tretë, nga ana e koncesionarit dhe financimit me hua bankare për të cilat paguhet interesa.

Shkeljet e Ahmetajt dhe zyrtarëve të ministrisë

KLSH konstaton se analiza e kryer nga Ministria e Financave dhe Ekonomisë është jo e plotë dhe nuk ka evidentuar problematikat në drejtim të flukseve të projektuara të parasë, burimet e nevojshme të financimit, treguesit kryesorë financiarë të projektit si dhe kostot kryesore që angazhojnë flukse dalëse të parasë. Në këtë mënyrë, për efekt të problematikave të vlerësuara më sipër nuk evidentohet të jetë refuzuar projekti, por është shprehur dakortësia në parim.

Konstatohet se ministria nuk ka analizuar në mënyrë të plotë përcaktimin e levërdisshmërisë së koncesionit në studimin e fizibilitetit në krahasim me alternativën e prokurorimit

Nga auditimi konstatohet se ministra nuk ka marrë asnjë masë për shmangien e risqeve financiare, duke qenë se është miratuar studimi I fizibilitetit që përfshin mbartjen e këtyre risqeve nga sektori public, duke lejuar mundësine e rritjes së pagesave nga buxheti për realizimin e projektit koncesionar

Për të gjitha shkeljet e konstatuara, në konkluzion, KLSH thotë se ngarkon me përgjegjësi ministrin e asaj kohë Arben Ahmetaj dhe 6 zyrtarë të tjerë.

“Për veprimet dhe mosveprimet e sipërme ngarkohen me përgjegjësi të gjithë përsonat nënshkrues të shkresës miratuese në lidhje me këtë projekt koncesionar” thuhet në raportin e KLSH.
