“30 qershori” Gjykata Kushtetuese pranon padinë e Voltana Ademit

Presidenti i Republikës dhe opozita kanë shënuar një hap përpara në betejën e tyre ligjore për të shpallur të pavlefshme zgjedhjet lokale të 30 qershorit. Tre gjyqtarë kushtetues në Dhomën e Këshillimit kanë vendosur që ta kualifikojnë padinë e Voltana Ademit për shqyrtim në seancën plenare të kësaj gjykate.

52 ankime të tjera janë rrëzuar që në këtë fazë, ndërsa kjo padi së bashku me padinë e Presidentit për Teatrin Kombëtar e kanë kaluar këtë filtër.

Kjo është vetëm faza e parë e shqyrtimit të kërkesës së kryebashkiakes së Shkodrës, pasi gjykimi dhe vendimi do të kryhen kur Gjykata Kushtetuese të plotësohet me të paktën edhe 2 anëtarë të tjerë.

Aktualisht kushtetuesja ka vetëm 4 anëtarë dhe të vetmet vendime që mund të marrë, janë ato për kalimin ose jo të çështjeve në seancë plenare.

Por që të ketë një vendim përfundimtar për zgjedhjet e 30 qershorit gjykata duhet të ketë minimalisht 6 anetare, dhe parashikimi se kur kjo mund të ndodhë është i paqartë.

Padinë në Gjykatën Kushtetuese për të shpallur të pavlefshme zgjedhjet e 30 qershorit u bë në 18 korrik nga kryebashkiakja në detyrë e Shkodrës, Voltana Ademi e cila kërkoi shpalljen antikushtetues të të gjithë procesit.

Ankimimi i saj prej 23 faqesh, kishte si argument kryesor faktin se data 30 qershor ishte anuluar me dekret presidencial dhe se në 31 bashki të vendit kandidatët socialistë nuk kishin rivalë.

Kërkesave të opozitës për anulimin e zgjedhjeve të 30 qershorit, diplomatët amerikanë i janë përgjigjur në mënyrë të vazhdueshme duke treguar derën e Gjykatës Kushtetuese, si e vetmja që do të vendosë nëse zgjedhjet ishin apo jo të ligjshme./abcnews.al
