Si ndyshon procedura për administrimin e pasurive të konfiskuara e të sekuestruara

Në kuadër të ndryshimeve ligjore që po bëhen së fundmi për zbatimin e asaj që ndryshe njihet si paketa “Anti KÇK” duhet thënë që janë bërë disa amendime edhe në ligjin ekzistues Nr 34/2019 “Për Administrimin e Pasurive të Sekuestruara e të Konfiskuara”.

Në këtë ligj janë amenduar shumë nene, por mund të përmendim si ri faktin që tashmë merr një rol të veçantë Komisioni Ndërinsitucional për Masat Kundër krimit të Organizuar.

Kështu në nenin 8 thuhet shprehimisht:

Shkronjat“c”, “e” dhe “ë” ndryshohen, si më poshtë vijon:

“c) me vendim Komisioni Ndërinstitucional për Masat Kundër Krimit të Organizuar realizon shitjen e pasurive të luajtshme të sekuestruara, të cilat me kalimin e kohës prishen, dalin jashtë përdorimit apo ju bie vlera në mënyrë të ndjeshme;

e) mbikëqyr veprimtarinë e përfituesit nga fondi i posaçëm për parandalimin e kriminalitetit, të cili i është dhënë në përdorim, përgjegjësi administrimi apo huapërdorje një pasuri e konfiskuar, nëse përdorimi i pasurisë është në përputhje apo jo me udhëzimin e ministrit përgjegjës për çështjet e rendit publik;

ë) bën verifikimin dhe përgatit dokumentacionin për vendimmarrjet e Komisionit Ndërinstitucional për Masat Kundër Krimit të Organizuar si dhe ndjek zbatimin e tyre.”.

Gjithashtu i janë dhënë me ligj tashmë shumë kompetenca edhe Ministrit të Punëve të Brendshme. Kujtojmë këtu që këto kompetenca në fushën e pasurive të sekustruara e të konfiskuara i ka pasur më parë Ministri i Financave.

Pika 2, e nenit 23, ndryshohet, si më poshtë vijon:

“2. Me kalimin e pasurisë në favor të shtetit, Agjencia përgatit raportin tekniko-financiar me rekomandimet përkatëse për destininim, mënyrën dhe kushtet e administrimit të pasurisë së konfiskuar dhe ia paraqet Komisionit Ndërinstitucional për Masat kundër Krimit të Organizuar dhe, për dijeni, ministrit përgjegjës për rendin dhe sigurinë publike, brenda 90 (nëntëdhjetë) ditëve, nga njoftimi i vendimit gjyqësor për konfiskimin e pasurisë.”.

Neni 24

Komisioni Ndërinstitucional për Masat Kundër Krimit të Organizuar vendos për destinimin e pasurive, si dhe për përdorimin efektiv të të ardhurave brenda buxhetit të shtetit, përfshirë edhe vendimin për pagimin e shpenzimeve operative të Agjencisë.”.
Neni 25

Në pikën 5, të nenit 30,fjalët “Ministri përgjegjës për financat, …” zëvendësohen me “Ministri përgjegjëspërrendin dhe sigurinë publike,…”.
