Dosja hetimore: Si u akuzuan nga Arben Kraja dy të rinjtë shkodranë pse donin të hynin në ambasada

Akt-akuza e publikuar nga Tufa mban firmën e Krajës dhe ndër të tjera të rinjtë akuzohen se “kishin shkelur moralin komunist” duke tentuar që të largoheshin nga vendi ndërkohë që “ishin kontaminuar nga ide armiqësore”.

Sëfundmi, vellai i Arben Luçit, Roland Luçi ka zbuluar përmbajtjen e dosjes dhe akuzës ndaj dy të rinjve duke hedhur dritë mbi atë ngjarje të 29 viteve më parë.

Përmes një postimi në Facebook, vëllai i Arben Luçit të arrestuar nga policia dhe të akuzuar nga Kraja shpjegon se si ndodhi gjithçka.

Sipas dosjes, dy të rinjtë nisen më datë 26 korrik 1990 nga Shkodra me qëllim futjen në ndonjë prej ambasadave perëndimore pas dyndjeve të 2 korrikut.

Luçi dhe Bizi nisen me trenin e orës 14:00 nga Shkodra për në Tiranë, por ndalen në Vorë pasi shohin se kishte shumë forca rendi që kontrolloni udhëtarët. Më pas, dy të rinjtë nisen në këmbë për në Tiranë, por kapen nga një patrullë policie dhe pas marrjes në pyetje nisen për në hetuesinë e Shkodrës.

Në lidhje me këtë, Roland Luçi, vëllai i Arben Luçit tregon përmes një postimi tjetër në Facebook se i riu ishte rrahur në hetuesi dhe e mbanin të lidhur në krevatin e spitalit me roje të armatosur në derë.

Ne vazhden e urimeve per shefin e SPAK, Arben Kraja, zbardhja e nje aktakuze ndaj dy personave “te rene pre e propagandes se armiqve te brendshem e te jashtem”, e formuluar dhe nenshkruar nga ai, hetues Arben Kraja, ne vitin 1990.

Arben Hiqmet Luçi,
Beniamin Fahri Bizi

Akuzohen se: në bashkëpunim me njëri-tjetrin kanë shkuar me datën 26.07.1990 në qytetin e Tiranës për të hyrë në një ambasadë të huaj e për të kaluar kufirin në mënyrë të kundraligjshme, vepër penale kjo që parashikohet nga neni 127 e 11/1 e 13 të Kodit Penal.

Hetuesia e Rrethit Shkodër në datën 27.7.1990 ka filluar çështjen penale në ngarkim të të pandehurve Arben Luçi dhe Beniamin Bizi, për veprën penale të përgatitjes për kalim të paligjshëm të kufirit. Nga hetimet e kryera ka rezultuar dhe provuar se:

Dy të pandehurit janë banorë të qytetit të Shkodrës dhe kanë shoqëri me njëri-tjetrin. Duke qenë të paformuar dhe me karakter të dobët, ata janë bërë pre e propagandës së armiqve të brendshëm e të jashtëm.

Të ndikuar nga propaganda që bënte televizioni dhe stacionet e huaja të radios për shtetasit shqiptarë që u futën në ambasadat e huaja, në fillim të muajit korrik, ata të dy kanë vendosur që me datën 27.7.1990 të ishin në Tiranë dhe atje të futeshin në një ambasadë të huaj duke realizuar kështu qëllimin e tyre për të dalë jashtë shtetit në mënyrë të kundraligjshme.

Dy të pandehurit takohen ndërmjet tyre me datën 25.7.1990 në darkë dhe e vendosin që të nesërmen me trenin e orës 14.00 që niset nga Shkodra të shkonin në Tiranë dhe të prisnin që me datë 27.7.1990 të futeshin gjatë ditës në ndonjë ambasadë.

Të nesërmen, pra me datë 26.7.1990 janë nisur për në Tiranë me trenin e orës 14.00. Nga shtëpitë e tyre janë larguar pa lënë adresë fare se ku do të shkonin. Pasi kanë arritur në Vorë kanë parë se kishte shumë policë që po kontrollonin personat e dyshimtë që ishin aty.

Në këto kushte, i pandehuri Beniamin i ka thënë të pandehurit Arben që të ktheheshin për në Shkodër. Por ky i fundit i vendosur plotësisht për veprën që do të kryente, nuk ka dëgjuar dhe bile ka ndikuar fort tek i pandehuri tjetër për t’ia mbushur mendjen që të vazhdonin rrugën për ku ishin nisur. Dhe kështu të dy të pandehurit zbresin nga treni në Vorë dhe nisen në këmbë, nëpër fusha për të hyrë fshehurazi në Tiranë.

Por gjatë rrugës ata u kapën nga një patrullë policie dhe shoqërohen fillimisht për një rajon policie në Tiranë dhe pastaj sillen në Shkodër dhe ndalohen. I pandehuri Beniamin e pranon plotësisht akuzën që i bëhet dhe paraqitet shumë i penduar për veprën që ka kryer. Ndërsa i pandehuri Arbeni mban qëndrim shumë negative gjatë zhvillimit të hetimeve dhe nuk pranon fare që të jetë nisur për të hyrë në ambasadë.

Në këto kushte, dy të pandehurit kanë konsumuar plotësisht elementet e veprës penale të përgatitjes për kalim të paligjshëm të kufirit, nëpërmjet hyrjes në ambasadë të huaj. Vepra e kryer nga të pandehurit paraqet rrezik të theksuar shoqëror. Po kështu, rrezikshmëri të theksuar shoqërore paraqet edhe i pandehuri Arben Luçi, i cili nuk pranon fare akuzën dhe mban një qëndrim shumë negative gjatë hetimit të çështjes.

Duke i konsideruar hetimet e plota dhe akuzën të vërtetuar në bazë të nenit 105 të Kodit te Procedures Penale, ju paraqesim për gjykim të pandehurit:

1-Beniamin Bizi, i biri i Fahriut dhe i Ylfetes, i datëlindjes 1964, lindur dhe banues në Shkodër, me kombësi dhe shtetësi shqiptare me origjinë dhe gjendje shoqërore punëtore me arsim 8 klasë, i pamartuar, i padënuar, pa imunitet, i arrestuar.

2-Arben Luçi i biri i Hiqmetit dhe i Liries, i datëlindjes 1962 lindur dhe banues në Shkodër, me arsim të mesëm, i paorganizuar, pa imunitet, i padënuar, me kombësi dhe shtetësi shqiptare, me origjinë nëpunës dhe gjendje shoqërore punëtore, i pamartuar, i arrestuar.

Akuzohen se: në bashkëpunim me njëri-tjetrin kanë kryer veprën penale të përgatitjes për kalim të paligjshëm të kufirit, që parashikohet nga neni 127 e 11/1 e 13 të Kodit Penal.

Akt akuza së bashku me materialet e tjera të dosjes hetimore i kalon për gjykim Gjykatës së Rrethit Tiranë.

Kjo akt akuzë u përpilua sot më datë 4.8. 1990 nga unë hetuesi Arben Kraja.

Postimi i dytë i Roland Luçit, ku tregon se si e gjeti të vëllain në spital pasi ishte marrë në pyetje

Arben Kraja, nje nga speciet e kalçifikuara qe as me 1990 nuk e kuptonte se regjimi te cilit i sherbente kishte marr fund, sot eshte shefi i SPAK.

Sot ngjarja tingellon groteske, po dikur ai dergoi tim vella ne Spaç per tentative arratisjeje.
Eshte histori interesante, lexim te kendshem per ata qe kane deshiren dhe durimin te lexojne shkrimin ne linkun me poshte.

Nje polic qe kishte qene me sherbim ne Degen e Brendshme, nje njeri i mire nga Dajçi (Preng Z. te cilin kam rast ta pershendes nqs e lexon), te cilin e kisha pasur nxenes ne shkollen e mesme, del ne mengjes te autobusi qe na çonte ne shkolle dhe me thote se yt vella eshte demtuar ne koke gjate hetuesise ne biruce dhe jane duke e çuar ne spital.

ishte vertet atje se ne koridorin e kirurgjise, para deres se nje dhome ndeshem ne nje polic me automatik qe bente roje, per fat i njohur i mikut e nxenesit tim. Ruante tim vella!

i çfare hetuesi kafshe, angazhonte police te armatosur me automatike me sherbim 24 oresh qe te ruanin ne spital nje djale te torturuar qe kishte tentuar te arratisej dhe ishte arrestuar ne…Tirane!

Nejse, jo te gjithe ishin ne nivelin e shtazerise se hetuesit tashme te famshem shef te SPAK-ut, rolin e te cilit do ta merrja mbas pak çastesh une!
Po, po, une,sepse polici roje hyri ne dhome dhe une i shoqeruar nga polici tjeter qe me pershperiti ne vesh “ben sikur je shefi” hyme mbas pak. Une nuk e kuptova ne fakt se çfare donte te thoshte, as ja vura fort mendjen fjaleve te tij. Dy policet po rrezikonin shume ne shkembim te nje gjesti human.

Sa hyme ne dhome, polici roje merr drejtqendrim dhe me pershendet me ze te larte “mirdita shef”. Aty e kuptova qe duhej qe te semuret e tjere ne dhome (ishin disa) te mos kuptonin se isha i vellai, te dukesha si hetuesi, mbasi im vella ishte ne hetuesi e nuk lejohej kurrfar kontakti me te.

Ngaqe ne Shkoder nuk isha krejt i panjohur, dikush nga te semuret ne dhome sigurisht qe me njohu se kush isha, por me mirkuptim dinjitoz sollen koken ne anen tjeter dhe une u ula per pak minuta prane tim vellai…i cili ishte i lidhur me pranga ne kembe dhe duar tek hekurat e shtratit!
Nje pamje kjo me makaber se sa plaga qe ai kishte ne koke.
