Ligji për dividentit ka qenë në foksu të deklaratës së Metës, sipas ë cilit është në shkelje të kushtetutës prandaj do të kallëzoj në SPAK personat përgjegjës që e kanë kaluar sipas tij në fshehtësi në Kuvend.
“Me pasoja të rëndë, për buxhetin dhe financat e shtetit, për sigurinë publike për të favorizuar një grusht oligarkësh që pasurohen në kurriz të shqiptarëve. Ligji për devidentit, rast flagrant se si kuvendi ka dhunuar hapur Kushtetutën për të cilën ju premtoj se do të japin llogari. Nuk do të ketë shpëtim për ta.
Kushtetuta, në nenin 18 ka përcaktuar se të gjithë qytetarët janë të barabartë para ligjit, por në nënin 155 është kujdesur të bëjë të qartë se taksat, tatimet dhe detyrimet financiare, lehtësimi ose përjashtimi prej tyre i kategorive të caktuara caktohen me ligj. Në këto raste ligjit nuk mund ti jepen fuqi prapavepruese. Sipas këtij neni është e qartë se cdo lehtësim fiskal nuk ka efekt prapraveprues. Barazia bara ligjit është tipar thmelor i kushtetutës, parim i njohur i financave publike.
Por në datën 3 dhjetor rilindja në 2018 miratoi ligjin për disa ndryshime në ligj për tatimin mbi të ardhurat në dëm të sipërmarrësve të ndershëm. Në këtë nen marvi kuvendi u vends nga 18% u bë 8% me efekt prapaveprues.
Ky parashikim dhunon nenin e kushtetutës që ndalon efektin prapaveprues, se kjo do të thotë diskriminim para ligjit. Pasojët e këtij krimi është e pabesë, goditje e rëndë pas shpine për bizneset e ndershëm që kanë paguar tatimin prej 15%, ndërsa me ligjin e ri oligarkët që kanë paguar deputetët do të favorizoheshin që të mos paguanin 15%, por 8%
përmbyset sistemi fiskal duke majmur më shumë shtresën e vogël dhe më të pasur të shoqërisë dhe duke varfëruar njerëzit e thjeshtë. Për këtë asre me dekretin e datën 20 dhjetor 2018 vendosa kthimin për rishikim, ky dekret iu përcoll kuvendit. Cfarë ndodhi? Në të njëtën ditë ku presidenti i thotë Kuvendit “thërriti mendjes se po bëni një krim financiar” në të njëjtën ditë kuvendi zhvilloi seancë plenare.
Komisioni Ekonomik shqyrtoi në mënyrë mafioze këtë ligj, pa thirru presidencën për të dhënë sqarime, pa lajmëruar opozitën dhe brenda po të njëtës ditë, e miratuan në seancë penale. Mavri Kuvendi dhunoi hapur dhe tmershëm kushtetutën, duke futun në mënyrë të fshehtë dekretin e presidentit për ta futur në fletoren zyrtare.
I kushton qindra mln euro buxhetit. Për këtë arsye iu bëj me dije se për këtë vendim do të paraqes në ditët e ardhme kallëzimin penal në SPAK për të zbardhur këtë skemë dhe vendosjen para drejtësisë autorëve të saj” tha Meta.
