Policia fiton të drejtën të përgjojë, Ahmet Premçi: Antikushtetuese, cenohet rëndë ndarja e pushteteve

Në nenin 131 të ligjit për policinë parashikohet ndryshimi që do ti japë të drejtë uniformave blu që të bëjnë përgjime pa pasur nevojë për një urdhër prokurori. Drafti në fjalë i jep të drejtë policisë që të kryejnë tri lloje përgjimesh; ambiental në ambiente publike apo në mjetet e transportit publik, përgjim me foto dhe video si edhe mbikëqyrjen e fshehtë të personave të dyshuar për kryerjen e veprimtarive kriminale.

Për të folur lidhur me këtë çështje, në studion e Ilva Now, ishte ish drejtori i përgjithshëm i Policisë së Shtetit, Ahmet Premçi përballë gazetarit të Euronews Albania, Eni Frehati.

I pyetur lidhur me shqetësimin sa i përket këtij ligji, z. Premçi tha se ky ligj është antikushtetues dhe bie ndesh me kodin e procedurës penale sipas të cilës të drejtën për të përgjuar e ka vetëm prokurori me lejen e gjykatës.

Premçi solli në vëmendje se në kohën kur ai ishte drejtor i përgjithshëm i Policisë së Shtetit janë shkatërruar banda të tëra kriminale nga Jugu në Veri, përmes përgjimeve të kërkuara nga policia e të kryera nga prokuroria, duke e bërë sipas tij jo vetëm të panevojshme, por edhe të paligjshme marrjen e një kompetence të tillë.

“Strukturat e policës janë në varësi të qeverisë, në varësi të ministrit të Brendshëm dhe kryeministrit.

Punonjësi i policisë është i elektrizuar nga ngjarja dhe puna që bën. Dhe po t’ia lësh në dorë punonjësit, nuk është i drejtë në ushtrimin e kësaj të drejte për të përgjuar këdo. Prokurori është më i ftohtë se polici, aq më tepër gjykatësi që jep leje. Ndarja e pushteteve cenohet rëndë me këtë ligj. Prokuroria është organi i vetëm i ndjekjes penale, dhe këtë e thotë Kushtetuta” tha z. Premçi.

Sipas ish-drejtuesit të policisë, në këto raste bashkëpunimi Polici-Prokurori ka qenë shumë i frytshëm dhe nëse ka pasur rrjedhje informacioni, kjo me gjasa ka ndodhur nga radhët e policisë, të cilët janë proceduar dhe dënuar për këtë gjë, dhe jo nga prokuroria.

“Një tentativë u bë në kohën kur Ministria e Brendshëm drejtohej nga Sajmir Tahiri për ta vënë byronë e hetimit në varësi të Ministrisë së Brendshme, gjë që u rrëzua nga Gjykata Kushtetuese.

Të njëjtën gjë po bëjnë edhe sot duke përfituar nga fakti se nuk ka Gjykatë Kushtetuese. Nuk ka asnjë model në vendet ku ne aspirojmë të afrohemi që e ka këtë” tha z. Premçi.

Gazetari i Euronews Albania, Eni Ferhati sqaroi se policia sipas këtij drafti, ka të drejtë të vërë nën përgjim këdo ndaj të cilit ka dyshime të arsyeshme se mund të kryejë një vepër penale, por ekziston mundësia dhe frika e keqpërdorimit të kësaj të drejte për shantazhe të ndryshme nga njerëz të caktuar në policinë e shtetit. Ai shprehu bindjen se kur ky ligj të kalojë për diskutim në komisionin e sigurisë, do të ketë reflektim nga ana e deputetëve në mënyrë që të mos krijohen probleme në të ardhmen.

“Është ndërhyrë shumë në ligjin për policinë e shtetit, sa herë është ndryshuar qeveria. Kjo sjell përplasje me prokurorinë” tha gazetari i Euronews Albania.
