Debati për kriminalizimin e fenomenit të shit-blerjes së votës, duket sikur këto kohë është i pranishëm më shumë se kurrë në arenën e debatit publik.
Në fakt kjo jo krejt pa asye. Deri më sot të gjithë e dinim se këtu blihet dhe shitet vota, të gjithë e dinim se këtu presionohet e kërcënohet për votën, të gjithë e dinim se premtohet e dhurohet për blerjen e votave, ama sot mbase jemi ndërgjegjësuar edhe më shumë mbi rrezikun e këtij fenomeni.
Ky ndërgjegjësim nëse mund ta quaj të tillë, qytetar dhe politik, ka ardhur përgjithësisht si pasojë e sistemit keqfunksional ku gjendet vendi, por më shumë se kaq edhe si pasojë e disa ngjarjeve të publikuara në media ku në qendër të tyre dilnin politikanë e drejtues të mazhorancës, që përfshiheshin në fenomenin e shit-blerjes së votave duke bashkëpunuar edhe me elementë kriminalë. E gjitha ajo që u përfol si skema e vjedhjes së votave në Dibër, është njohur tashme me emrin “Dosja 184”.
Parashikimet e dispozitave të Kodit Penal që flasin për ndërhyrjet në procesin elektoral, janë të grupuara në KREUN 10 të Kodit dhe janë cilësuar si VEPRA PENALE QË PREKIN ZGJEDHJET E LIRA DHE SISTEMIN DEMOKRATIK TË ZGJEDHJEVE. Ky kre ka parashikuar gjithsej 12 nene dhe varjojnë nga neni 325 deri në nenin 332.
Të gjithë këto dispozita janë të mirëprcaktuara, por në asnjërën prej tyre nuk flitet qartë për shitjen ose blerjen e votave. Vetëm neni 328 duket sikur e mbulon këtë fenomen, por në të vërtetë edhe ai është shumë evaziv dhe madje e kategorizon këtë vepër si kundravajtje penale, kur në të vërtetë përbën dhe duhet të përbëjë krim.
Ndaj edhe ëshë padyshim i nevojshëm shtimi i një neni që të rregulllojë në mënyrë konçize e të qartë fenomenin e shit-blerjes së votave, e parashikuar kjo në Kodin Zgjedhor në mënyrë që t’u paraprihet qartë ngjarjeve si ajo e Dibrës dhe të mos jemi sot në këtë “batakun” e diskutimit nëse duhet apo jo që të kriminalizohet shitblerja e votës.
Pra në një shtet demokratik ky debat as duhej bërë, jo më që të shkruanim e të shqetësoheshim për këtë.Vetëm parashikimi i qartë penal dhe pa ekuivoke që do ta kategorizonte fenomenin e shitblerjes së votave si krim, do të jepte impuls pozitiv në drejtim të reduktimit apo eliminimit të këtij fenome
